Several Opinions of Supporting High-quality Development of Private Economy

To each People’s government, each district and county (county-level city and district) people’s government, each department of provincial government and subordinate agencies, each large enterprise, each college and university,

In order to further study and implement thought on socialism with Chinese characteristics for a new era and the spirit of the 19th CPC national congress, implement the spirit of General Secretary Xi Jinping's important speech at the symposium on private enterprises, work hard to resolve the outstanding difficulties and problems hindering the development of the private sector, optimize development environment ceaselessly, promote high-quality development of private economy in the province, give better play the important role of the private sector in advancing supply-side structural reform, conversion of old and new kinetic energy, and building a modernized economic system, and the following opinions are put forward as below after study by the Provincial Party Committee and Provincial Government.

        I. Lighten the tax and fee burden of enterprises; enhance the competitiveness of private enterprises

         1.We will promote tax and fee reduction. Implement the special inspection of tax and fee reduction, promote such tax and fee reduction policies to be implemented comprehensively as weighted deduction of research and development expenditure introduced by the state, high-tech corporate income tax preference as well as the preference tax policies as the reduction of city and town land use tax, stamp duty, vehicle and vessel tax etc. The enterprises that have special difficulties in paying a taxes on time could file an application as per the related regulations of tax law and defer to pay after approval with the delay time no more than 3 months (the Provincial Department of Finance and the Provincial Tax Bureau shall take the lead) The minimum wage standard shall be adjusted smoothly by combining with relevant state requirements and enterprise demands (the Provincial Department of Human Resources and Social Security shall take the lead). For the eligible insured enterprises that work hard to stabilize employment, 50 percent of unemployment insurance expense paid by them and their employees shall be reimbursed to them and by means of fees reduction. For the existing policies of which the total sum of the unemployment insurance contribution ratio paid by employer and employee is reduced from 3 percent periodically to 1 percent, they would be continued to be implemented when it expires at the end of April, 2019. The existing insurance premium collection policies shall be guaranteed in the process of institutional restructuring, and it is strictly prohibited to conduct centralized settlement of historical arrears of enterprises. (The Provincial Department of Human Resources and Social Security, the Provincial Department of Finance and the Provincial Tax Bureau shall take the lead). Strengthen supervision and management of fees charged by enterprises involved, make smooth the informant channel for enterprises, improve investigation mechanism, and resolutely ban the illegal charges (the Provincial Market Supervision Bureau and the Provincial Department of Finance shall take the lead).

   2.We will reduce the land use cost. For the key projects with strong driving forces that are in line with direction of conversion of old and new kinetic energy, special index of provincial land plan or the mode of joint supply by the province, cities and counties shall be adopted to guarantee the land use. For the industrial projects with priority and land-intensive development determined by each city, the land transfer reserve price can be executed as per no less than 70 percent of the corresponding levels in National Bottom Price Standard for Industrial Land Transfer. It can be adopted of long-term lease, lease to transfer, combination of lease and transfer, flexible transfer for industrial land for land supply, and those by long-term lease can be adjusted to and supply transfer; those by flexible annual lease can be renewed for the projects in line with the industry orientation; those by long-term lease, lease to transfer, flexible annual lease to acquire the land use right can be sublet, transferred or pledged according to law within the term of use. It is supported and encouraged to build high standard factory in various regions while they can be registered and transferred into basic units according to buildings, floors and other enclosed spaces with independent ownership boundaries. On the premise of conforming to the plans with no change of use, those that rebuild or extend the construction to industrial workshop and ware house land and take advantage of underground space so as to increase plot ratio and building density shall not be levied land balance.  (The Provincial Department of Natural Resources shall take the lead)

   3.We will come to grip with the historical problems related to enterprise land and housing property rights. In accordance with the principle of handling special cases with special methods and solving problems properly and rapidly, relevant provincial departments study and put forward the concrete guiding opinions for solving the historical problems of enterprise land and housing property rights by the end of the year. Each city, county (county-level city, district) should push forward to conducting a thorough investigation, for the historical problems of incomplete enterprise land use right and building ownership can be solved by categorization by means of obliges or users to file an application and provide the relevant materials of land and buildings by the end of March, 2019. (The Provincial Department of Natural Resources, the Provincial Department of Industry and Information Technology shall take the lead)

4.We will lower the logistics cost. The toll gates on the national and provincial highway shall be cancelled gradually within three years except for those on expressways. The existing preferential policies of ETC toll fees shall be continued, and differentiated charges of expressways shall be advanced (The Provincial Department of Transportation shall take the lead). The reformation of electric power system shall be continued to be deepened so as to expand the market trading volume of electricity. Eligible private enterprise natural gas users shall be supported to shift from indirect supply to direct supply so as to lower the gas consumption cost. (The Provincial Bureau of Energy and the Provincial Bureau of Housing and Urban-Rural Development shall take the lead)

5.We will strengthen the support of environmental capacity. We will carry out the benefit evaluation of unit energy consumption by regions, industries and enterprises. Governments at all levels shall take comprehensive advantages of differentiated measures including land use, energy use, price, loan and environmental rights and interests based on the evaluation results of enterprises so as to force the backward production capacity out of market and free up the environmental capacity for efficient enterprises. We will build coal consumption index allocation mechanism, formulate coal consumption index purchasing and allocation management method, and the coal consumption indexes vacated from shutting down and weeding out enterprises to be remediated shall be purchased, stored, managed and allocated as per certain proportion for the use of supporting the key projects that are in line with the conversion of new and old kinetic energy. We will carry out pilot work of compensable use and trading of energy consumption right, and establish the trading system of energy consumption right. Encourage to attract private capital to enter the energy conservation service industry including energy performance contracting, and actively cultivate third-party certification and evaluation organizations (The Provincial Development and Reform Commission shall take the lead). Study and formulate compulsory liability insurance for environmental pollution by enterprises to dissolve risks of corporate environmental responsibility (The Provincial Department of Ecological Environment shall take the lead)

6.We will support innovative development of private enterprise. We will implement multiplication plan of high-tech enterprises, establish cultivation pool of high-tech enterprises, increase the quantity of high-tech enterprise accreditation, and the total number of high-tech enterprises in the province will be doubled by 2022 than that in 2017( The Provincial Department of Science and Technology, the Provincial Department of Finance and the Provincial Tax Bureau shall take the lead). Carry out the cultivation action of gazelle and unicorn enterprises, rewards and financing support shall be given to recognized gazelle and unicorn enterprises by the provincial finance by category (The Provincial  Department of Industry and Information Technology and the Provincial Department of Finance shall take the lead). From Jan.1, 2019 to Dec. 31, 2021, For national and provincial science and technology business incubators, university science and technology parks and national archival maker space for self-use, as well as properties and land provided to incubated objects for free or through rental, property tax and urban land use tax will be exempted; and the gained income from providing the incubation service for the incubated objects shall be exempted from value added tax (The Provincial Department of Finance, the Provincial Tax Bureau, the Provincial Department of Science and Technology and the Provincial Department of Education shall take the lead) Support private enterprises to take the lead to implement national major science and technology projects, and the provincial science and technology fund shall be given coordinative supports. For the enterprises that successfully establish national technology innovation center, manufacturing innovation center, they shall be given 10 million to 30 million yuan of financial support per one (The Provincial Department of Finance, the Provincial Department of Science and Technology, and the Provincial Department of Industry and Information Technology shall take the lead). Make good implementation of the Opinions on the CPC Shandong Provincial Committee and People’s Government of Shandong Province on Talent Support of Conversion of New and Old kinetic Energy Work, relying on “www. Sdrc.com.cn” “Shandong International Talent Network” to set up a docking supply and demand platform of high-level talents that integrates demand post, online communication, talent recommendation as one, support and guide private enterprises to introduce various talents in urgent need including excellent professional managers, high technicians (The Organization Department of Provincial Party Committee, the Provincial Department of Human Resources and Social Security and the Provincial Department of Science and Technology shall take the lead). Each local governments are encouraged to take advantage of idle office occupancy, school buildings, factories, cultivate and introduce a batch of human resources service organizations, and the organizations settled shall be given rent reduction in certain period and those that rent office occupancy voluntarily can be given certain amount of rent subsidies (The Provincial Department of Human Resources and Social Security and the Provincial Department of Finance shall take the lead)

7.We will give full play to the role of government procurement in supporting private enterprises. On the premise of meeting the basic requirements of their own operation and the provision of public services, departments at all levels shall reserve at least 30 percent of annual total budget for government procurement projects specially towards medium, small and micro enterprises, among which the proportion for small and micro enterprises shall no less than 60 percent (Financial departments at all levels shall take the lead). Implement government procurement contract financing system, so that the private enterprises that participate in government procurement activities and win a bid can apply for financing from the cooperative financial institution by virtue of government procurement contracts (People’s Bank of China-Jinan Branch, the Provincial Department of Finance shall take the lead).

8.We will encourage private enterprises to expand foreign market. Since the year of 2019, the provincial finance shall raise the subsidy standard for exhibition stand fees to more than 80 percent of key exhibitions in “the Belt and Road” countries and emerging markets. 50 percent of export credit insurance premiums shall be subsidized for those enterprises exporting to “the Belt and Road” countries and emerging markets; the export credit insurance premiums under the provincial export credit insurance unified platform of small and micro enterprises shall be fully returned. For the provincially recognized overseas location, each one of them shall be given support as most as 1.5 million yuan (The Provincial Department of Commerce and the Provincial Department of Finance shall take the lead). We will build a sound joint work mechanism of risk prevention for private enterprises “going out”, improve risk guarantee service platform and information service platform so as to provide information counseling, risk warning and other services for private enterprises “going out”. (The Provincial Department of Commerce, the Provincial Development and Reform Commission and the Provincial Foreign Affairs Office shall take the lead).

  9.We will comprehensively promote the management level of private enterprise. Encourage private enterprises to modern enterprise system, improve corporate governance structure, focus on industry, highlight the main business, enhance industrial competitiveness, and strengthen the understanding of policies and application level. Continue to implement the dual increasing strategy of governance structure and industrial structure of small and micro business, push forward the work of individual-to-private, small and micro business to enterprise above designated size, enterprise above designated size to joint equity enterprise, joint equity enterprise to listed enterprise”, we plan to cultivate 10 thousand small and micro business to enterprise above designated size from 2018 to 2022 while each local government can render rewards as per 50 percent of the tax actually paid of the additional part of local finance. (The Provincial Market Supervision Bureau, the Provincial Department of Industrial and Information Technology, the Provincial Department of Finance shall take the lead). It is allowed for the small and micro business after transforming from individual business to use the original business name, and by 2020, 100 thousand individual businesses shall be guided and supported to transform into small and micro business (the Provincial Market Supervision Bureau shall take the lead). The training to private entrepreneurs shall be strengthened, the three-year action plan of private business successor and the entrepreneur development pilot program be implemented, training resources for various private entrepreneurs be integrated, annual training plan be formulated as a whole, training contents be classified and designed so that the trainee could choose suitable category independently and finance at all levels assume the study and training expenditure (The Provincial Department of Industrial and Information Technology, the Provincial Market Supervision Bureau and the Provincial Department of Finance shall take the lead)

  II. Solve the problems of difficult and expensive financing for private enterprises, improve financing service level

  10.We will intensify the implementation of monetary policy. Give full play to the guiding role of central bank monetary policy tools such as refinancing and rediscounting; encourage financing institutions to use small refinancing and rediscount funds, and mainly support the financing for private, small and micro businesses. Financing institutions should implement the management policy of small loan refinancing and rediscount, strengthen the management of standing book, flexibly apply the mode of loan-to-borrow or borrow-to-loan, and mainly support private, small and micro businesses. We will launch the key support business note express, and give preferential rediscount support to the bills of small and micro enterprises with single household single signature amount of 5 million yuan or less and the bills of private enterprises with single household single signature amount of 30 million yuan or less. (People’s Bank of China-Jinan Brach shall take the lead).  

  11.We will improve the service capacity of financial institutions. Local financing institutions should optimize credit appraisal technology, and provide accurate service for private enterprises through improving the capacity of data analysis. We will support financing institutions in issuing asset-backed securities for loans to small and micro businesses, and relax the basic assets of loans for small and micro businesses from 1 million yuan and below to 5 million yuan and below. We will encourage financial institutions to issue financial bonds for small and micro businesses, and enhance the ability to serve private enterprises. (People’s Bank of China-Jinan Brach shall take the lead)

12.We will improve supervision, assessment and internal incentive mechanisms of financial institutions. We will implement the relevant requirements of the Banking and Insurance Regulatory Commissioning on supporting the development of private enterprises, build a differentiated supervision mechanism to link bank performance evaluation with supporting the development of the private sector, and increase the assessment of business weight of credit extension for small and micro businesses and risk tolerance. We will supervise and urge financing institutions to make clear of the due diligence exemption standards of credit extension for small and micro businesses, lower the assessment of business weight of profit indicators of the employees in the financing institutions operating small and micro business, and increase the assessment of business weight of the number of loan accounts. The supervision department shall guide financing institutions to delegate certain the power of examination and approval appropriately, and take measures to give positive incentives to the financing institutions with a large loan base and a high proportion of loans to small and micro businesses. (Shandong Banking and Insurance Regulatory Commissioning shall take the lead).

  13.We will standardize the conduct of financial institutions. We will carry out a special action to rectify market turmoil in banking institutions, supervise and urge banking institutions to further implement the relevant policies and regulations of service price, focus on cleaning up various illegal financing channel business including depositing loan in the bank, linking deposits with loans, charge fees by loan, converting interest into fees, compulsory sales of financial products by financing, floating interest rate by 1.1 times, passing on cost and so on. Banking institutions should treat different ownership enterprises equally without decimation, and we should give and continue the loans instead of blindly withdrawing loans or compressing loans for enterprises that are in normal production and operation yet temporarily encountering difficulties. (Shandong Banking and Insurance Regulatory Commissioning shall take the lead).

 14.We will promote the implementation of credit financing programs for private enterprises. We shall rely on Shandong province enterprise financing service network system to integrate all the information including enterprise financing demand, finance supply, credit-solicitation services, import and export, tax and social security, and set up a provincial comprehensive service platform for enterprise financing; we shall encourage the development of market-oriented credit reporting services, apply such means as big data to analyze the operation and credit situation of private enterprise so as to provide support for financing institutions to expand private enterprise credit loan scale. (People’s Bank of China Jinan Branch, the Provincial Big Data Bureau, and the Provincial Local Financial Supervision Bureau shall take the lead)

  15.We will improve the government guarantee system for financing. We shall accelerate the integration progress of provincial government-oriented financing guarantee group to strive for national financing guarantee fund support, and construct provincial, municipal and county-level government-based financing guarantee system (The Provincial Department of Finance shall take the lead). We shall support the development of government-oriented financing guarantee institution, explore to build a diversified mechanism for replenishing funds mainly through financial contributions, implement rewarding policies of financing assurance, increase the assessment of weight of social benefits and long term benefits, and relax profit assessment indicators. The provincial finances shall give rewards to those that expand the financing and guarantee scale for small and micro business, lower the rate of credit guarantee fee with significant effect. (The Provincial Department of Industry and Information Technology, the Provincial Department of Finance, the Provincial State-owned Assets Supervision and Administration Commission, and the Provincial Local Financial Supervision Bureau shall take the lead)

16. We will improve the loan risk compensation mechanism for small and micro businesses. For the working capital loans and technical renovation project loans granted by financing institutions to small and micro business, in case of the loan balance of a single enterprise no more than 10 million yuan and the granted loan being recognized as non-performing assets (not including the guarantee loans by government-oriented financing guarantee institutions), the provincial risk compensation fund shall give the cooperative financing institutions loss compensation at 30 percent of the loan principle (The Provincial Department of Industry and Information Technology, the Provincial Department of Finance, and the Provincial Local Financial Supervision Bureau shall take the lead). We shall continue to implement such loan risk compensation policies as commercialization of research outputs and intellectual property mortgage (The Provincial Department of Science and Technology, the Provincial Market Supervision Bureau and the Provincial Department of Finance shall take the lead).

 17.We will support the direct financing by private enterprises. We shall implement rewarding policies of enterprises taking advantage of multi-level capital market for direct financing, establish and improve work coordination mechanism, study to solve various problems of land, planning and construction encountered in the process of public listing, make a good job of training service work for medium and small science-and-technology enterprise to land in Shanghai science and innovation board, and support private enterprises for public listing through multi-level capital market (The Provincial Local Financial Supervision Bureau shall take the lead). We shall encourage social capital to set up equity and venture capital funds, and governments at all levels could give financial support by means of holding shares and rewarding subsidies (The Provincial Local Financial Supervision Bureau and the Provincial Department of Finance shall take the lead). We shall improve the performance evaluation assessment and incentive mechanism of government-oriented funds, innovate operation mode, accelerate the government-oriented fund raising and delivery progress such as old and new kinetic energy conversion fund, give full play to the guiding and leveraging effect on the development of private enterprises. (The Provincial Department of Finance shall take the lead). We shall make good use of “private enterprise bond financing support instrument”, reinforce coordination efforts with China’s National Association of Financial Market Institutional Investors, actively promote the cooperation between the provincial financing institutions with China Bond Insurance Corporation, and support the private enterprises in the province to carry out bond financing (The Provincial Local Financial Supervision Bureau and People’s Bank of China Jinan Branch shall take the lead). We shall make good use of private enterprises equity financing support instrument established by People’s Bank of China to provide periodical equity financing support for the private enterprises running into financial difficulties. (The Provincial Local Financial Supervision Bureau, People’s Bank of China Jinan Branch, Securities Regulatory Commission of Shandong Province shall take lead.)

18.We will take powerful measures to defuse liquidity risks. We shall incorporate the listed companies with marketable products and promising development prospects yet with short-term liquidity difficulty and private large and medium-sized enterprises with standardized corporate governance into the bailout list. (The Provincial Local Financial Supervision Bureau, the Provincial Department of Industry and Information Technology and the Securities Regulatory Commission of Shandong Province shall take lead). We shall establish a bailout fund of 10 billion yuan, which will be guided by the government contribution and funded by financial institutions such as provincial-level state-owned capital operation platforms and securities companies to attract private capital, for the sake of effectively solving the risk of liquidation by pledge of equity of listed company while necessary assistance shall be given to eligible enterprises and their controlling shareholders on the bailout list. (The Provincial State-owned Assets Supervision and Administration Commission, the Provincial Department of Finance and the Provincial Local Financial Supervision Bureau shall take the lead). We shall formulate and implement guidelines on emergency loan transfer funds for enterprises, establish refinancing coordination mechanism consisting of governments, financial regulators and financing institutions, the provincial finance arrange guidance fund, encourage municipal and county level governments to contribute funds to attract private capital to co-establish emergency loan transfer fund and lower the cost of loan transfer of enterprises (The Provincial Department of Finance, the Provincial Local Financial Supervision Bureau and Shandong Banking and Insurance Regulatory Commissioning shall take the lead). We will improve the assessment and incentive mechanism, and the financing institutions with good policies on non-repayment and renewal of loans will be rewarded while the specific measures will be formulated separately. (The Provincial Department of Finance, the Provincial Local Financial Supervision Bureau and Shandong Banking and Insurance Regulatory Commissioning shall take the lead). We shall carry out in a deep-going way the special action of accounts receivable financing of small and micro businesses, guide core enterprise in supply chain, commercial banks and service platforms of accounts receivable financing to make systematic docking, and help small and micro business suppliers to carry out financing (People’s Bank of China Jinan Branch shall take the lead). We will support the enterprises that are in line with the direction of the conversion of new and old kinetic energy of growth and are experiencing temporary difficulties to implement market-oriented debt-for-equity swaps in accordance with national regulations. (The Provincial Development and Reform Commission, the Provincial Local Financial Supervision Bureau and Shandong Banking and Insurance Regulatory Commissioning shall take the lead). We shall incorporate the private enterprises with debt risk and large scale of loan, many creditor banks and complex guarantee relationship into the provincial risk enterprise ledger to defuse risks by corresponding tactics. We shall guide the establishment of a bank creditors committee to coordinate the concerted action of creditor banks and help them with tiding over difficulties. (The Provincial Local Financial Supervision Bureau and Shandong Banking and Insurance Regulatory Commissioning shall take the lead).

  III.Create a fair competition environment; expand the development field of the private sector

 19.We will ensure equal status for private enterprises. Department at all levels should take a holistic and strategic perspective to fully understand the importance of accelerating the development of private economy, adhere to the basic economic system, insist on "two unwavering" and "three unchanged", unswervingly promote the development of the private sector, treat equally without discrimination on the policy implementation, and treat them fairly in the process of market competition. We shall strictly implement a fair competition review system and prohibit the setting of unreasonable conditions that restrict or exclude private enterprises in the bidding and tendering of construction projects, government procurement, and transfer of state-owned land and mining rights and transaction of state-owned property rights. No threshold for initial performance shall be set up for private enterprises with relevant industrial qualifications to participate in major government-led construction projects. We shall various “rolling doors” “glass doors” revolving doors”, so as to level the playing field for private enterprises in the respect of market access, approval license, operation, bidding and tendering as well as military and civilian integration. (The related departments at various levels shall be responsible).

20.We will expand the scope of private capital investment. We will fully implement the negative list system for market access in accordance with the unified national plan. We will deepen reform of the investment and financing systems in monopoly industries, infrastructure and social programs, break down industry monopoly and market barrier, accelerate the opening up of these sectors to private capital, and it is forbidden to set exclusion clauses or set thresholds in disguised form by setting additional conditions. (The Provincial Development and Reform Commission shall take the lead). We shall seize the opportunity of the state government’s strengthening the construction of transportation infrastructure currently, select a batch of expressway, airport and seaport projects to carry out investment demonstration of private capitals, set up scientific and reasonable investment return mechanism, and attract private capitals to participate in the construction and operation (The Provincial Department of Transportation shall take the lead). We shall straighten out the pricing mechanism and investment compensation mechanism for infrastructure products and service, attract private capital to invest and run urban municipal infrastructure projects including urban water supply, gas supply, fuel gas, sewage disposal, urban rail transit, parking facilities by various means such as asset securitization, franchising, Public-Private-Partnership. We shall encourage local governments to adopt such means as entrusted operation or transfer-operation-turn over to transfer the constructed municipal infrastructure to private capital for running and management, and liquidize remnant assets(The Provincial Housing and Urban-Rural Development Bureau, the Provincial Development and Reform Commission and the Provincial Department of Finance shall take the lead). We shall support private capital to hold shares or establish relevant industrial investment fund, infrastructure investment fund, and participate in the provincial strategic emerging industries and major infrastructure projects. (The Department of Finance shall take the lead).

     21.We will encourage private capital to participate in mixed-ownership reform of state-owned enterprises. We shall vigorously promote in-depth integration of state-owned enterprises and private capital, and set no threshold, no limit on shareholding ratio and no limit on areas of cooperation for private capitals. On the basis of mixed ownership reform pilot in the early stage, additional 93 premium projects of provincial state-run enterprises shall be selected to introduce private capital for the implementation of mixed ownership reform. We shall highlight the key role of corporate law and articles of incorporation in corporate governance, and protect the legal interests of various investment entities in accordance with the law; we shall improve the system for major investment, decision-making and management in mixed-ownership enterprises to ensure that private and state capital draw on each other's strengths, pursue integrated development, and achieve mutual benefit. (The Provincial State-owned Assets Supervision and Administration Commission shall take the lead)

  22.We will support private capital to carry out mergers and acquisitions. Enterprises registered in our province after trans-provincial and cross-border mergers and acquisitions shall be rewarded as per the means of “one project one discussion” by local governments. For legal, financial and other intermediary service fees actually incurred during the merger and reorganization of the top 500 private enterprises, listed enterprises and industry leading enterprises, local governments could give 50 percent subsidies after the successful mergers and acquisitions with the subsidies of each single project no more than 1 million yuan. (Financial departments at all levels shall take the lead). We shall guide the bank institutions in the province to actively yet prudently conduct M&A loan business on the premise of controllable risks, and implement comprehensive credit granting for enterprises after merger and acquisition. (Shandong Banking and Insurance Regulatory Commissioning shall take the lead). After mergers and acquisitions, enterprises that are allowed to merge separate should transact company cancellation, establishment or change of registration at the same time. (The Provincial Market Supervision Bureau shall take the lead). We shall take good advantage of new policies on mergers and acquisitions such as “quick petty loan” “separated channels”, strengthen the efforts of policy interpretation and business training, and support listed company to carry out mergers and acquisitions. (The Provincial Monetary Authority and Shandong Banking and Insurance Regulatory Commissioning shall take the lead).

   23.We will support private enterprises to participate in the integrated military-civilian development. We shall innovate “military-for-civilian”, “participating in military industry” policy mechanism, improve incentive policies of “enlist civilians into the army”, and support eligible civilian enterprises and private enterprises to actively participate in the integrated military-civilian development. We shall support private enterprises to participate in reform and recombination of military research academies and institutes and defense industry enterprises by means of equity cooperation and joint venture cooperation. We shall explore to establish integrated military and civilian service platform to provide demand publishing, policy consulting, qualification transaction, product display and other services for “participating in military industry” enterprises, strengthen the credit evaluation management of “participating in military industry” enterprises and public institutions, and create a good environment of deep development of military and civilian integration. ( The Military and Civilian Integration Office of the Provincial Party Committee and the Provincial Department of Industry and Information Technology shall take the lead.)

   IV.Construct a close and honest relationship between politics and commerce, comprehensive optimize government affairs service

 24.We will improve the system of liaison services. Department at all levels shall take it as an important duty to support the high-quality development of the private economy, continue to implement the system of leading cadres liaison with and serving enterprise, led by the provincial standing committee, each provincial leader at least contact one key project and two private enterprises that are in line with the direction of new and old kinetic energy conversion, respectively contact one particular chamber of commerce of Shandong province in other provinces and one chamber of commerce of other provinces in Shandong province, superior leaders lead subordinates, and put themselves into other’s shoes to exclude the difficulties and anxieties for enterprises. (The United Front Work Department of the Provincial Party Committee, the General Office of the Provincial Party Committee and the General Office of the Provincial Government shall take the lead). We shall carry out the campaign in a deep-going way to bring 1000 cadres to the grass-roots level to propagandize the party’s policies, promote the implementation of the policies, and help the enterprise with practical problems. (The Organization Department of Provincial Party Committee shall take the lead). Federation of Industry and Commerce and other mass organizations, associations and chambers of commerce should give full play the role of bridge and ties in the communication between enterprises and governments, strengthen the liaison with enterprises. We shall formulate a “negative list” of political and commercial connection so as to draw a “safe area” for broad masses of cadres serving enterprises and normal communication with entrepreneurs. (The Provincial Supervisory Commission shall take lead).

  25.We will deepen the reform of “streamlining administration and delegate power to the lower levels, and reducing barriers to entry”. We will spare no efforts to promote the reform of “do it well once”, and organize to carry out ten specific actions of optimizing business environment (The General Office of the Provincial Government, and the State Commission Office of Public Sectors Reform of the Provincial Party Committee shall take the lead). We shall accelerate digital information sharing and exchange progress between various departments and all walks of life, spare no efforts to solve the key problems of electronic archives, electronic signature and identity authentication, promote the construction of “Internet+ governmental service, strengthen the evaluation of window personnel by information means, and live up to “one set of materials to be accepted at one window, one sheet of registration to be transacted on one website”. (The General Office of the Provincial Government and the Provincial Big Data Bureau shall take the lead). We shall implement such modes as preliminary review of incomplete formalities and integrated evaluations, and carry out pilots of a commitment system for examining and approving enterprise investment projects. (The Provincial Development and Reform Commission and the Provincial Bureau of Housing and Urban-Rural Development shall take the lead). We shall deepen the reform of commercial system and government review and approval, comprehensively carry out “the separation of business license and business certificate”, and continue to expand the reforms of “integration of multiple certificates” on the basis of “integration of 45 certificates as one”, and promote full electronic registration and the application of electronic business license. (The Provincial Market Supervision Bureau and the Provincial Department of Justice shall take the lead). Government Affairs Service Center at all levels shall set approval service agent window, improve agent mechanism, and provide full service agent with no charge of the relevant approval process for enterprises. (The General Office of the Provincial Government shall take the lead). We shall regularly carry out the comprehensive evaluation of the business environment in the whole province. (The Provincial Development and Reform Commission shall take lead). We shall comprehensively carry out the supervision of dual randomness and one publicity” and innovate the inclusive and prudent supervision method suitable for “four new”. We shall enhance the construction of integrated enforcement force, carry out cross-agency random inspections and joint law enforcement in the field of market supervision, implement the same commercial entity of multi-department law enforcement inspection items completed at one time, and live up to “inspection at one time, overall examination”. (The Provincial Market Supervision Administration shall take the lead.)

 26.We shall clear up the communication channels between government and enterprises. Government sectors shall study and formulate enterprise-involved policies, and invite enterprise representatives to take part in, actively listen and adopt the advices and suggestions proposed by enterprises and related associations and chamber of commerce. Private enterprises and chamber of commerce organizations such as president unit of industry association of top ten industries can attend relevant meetings held at the provincial level. Provincial Party Committee and Provincial Government documents within the scope could be released to the president enterprise of industry associations. (The General Office of the Provincial Party Committee shall take the lead). We shall regularly hold special meeting of president of industry association to study the urgent problems in the development of the industry. (The Provincial Development and Reform Commission and the Provincial Department of Civil Affairs shall take the lead). On the basis of public service platform for middle and small enterprises in the province, we shall build a comprehensive service platform for private enterprises that integrate policy interpretation, enterprises appeal relief and other functions as one, clear up the communication channels and establish a coordinative resolution mechanism of department linkage, timely response to and solve the reasonable demands of private enterprises, and promote the service level to private enterprises. (The Provincial Department of Industry and Information Technology shall take the lead)

  27.We will create an atmosphere of innovation and entrepreneurship. We shall give full play to the role of the mainstream media in guiding public opinions, establish and improve a mechanism for collecting, evaluating, handling and responding to public opinions in government affairs, timely and accurately release authoritative information, actively interpret national and provincial policy measures to promote the development of private investment, stabilize and improve market expectation, and boost entrepreneurial confidence. (The Provincial Party Committee Propaganda Department, and the Provincial Department of Industry and Information Technology shall take the lead). Regularly hold private economy development conference and Confucian businessman conference. (The Provincial Department of Industry and Information Technology, the Provincial Department of Commerce, and the Provincial Federation of Industry and Commerce shall take the lead). We shall establish recognition system for private economy and continuously carry out the selection and commendation activities for outstanding builders of socialism with Chinese characteristics from non-public sectors. The provincial government will select a batch of excellent private enterprises, small and micro businesses each year and each city, county (county-level city, district) shall also carry out recognition activities according to the rules, advocate spirit of entrepreneurs, and invigorate enthusiasm and vitality of entrepreneurs for innovation and entrepreneurship. (The Propaganda Department of the Provincial Party Committee, The United Front Work Department of the Provincial Party Committee and the Provincial Department of Industry and Information Technology shall take the lead).

   V.Protect personal and property safety of entrepreneurs; safeguard the legal interests of private enterprises

  28.We will improve the system of social integrity. We shall strengthen government commitments, intensify awareness of responsibility, governments at all levels shall not refuse to fulfill policy commitment and various signed contracts, agreements on the account of such reasons as leadership change and replacement of relevant responsible personnel, and resolutely avoid the behaviors of “new leadership ignore the old accounts”. (Governments at all levels shall be responsible) . We shall carry out special inspection on the unfulfilled matters made by governments and the enterprises, carefully review the unfulfilled commitments made by the government and enterprises, and seriously pay attention to the rectification. (The General Office of the Provincial Government shall take the lead). We shall strengthen the construction of corporate integrity system, improve the mechanism of joint incentive for keeping promises and joint punishment for breaking promises, establish a system of credit “red and black list” of all industries to make the enterprises with serious discredit problems has nowhere to run and create a better development environment for enterprises with good credit. (The Provincial Development and Reform Commission shall take the lead). We shall give full play to the role of chamber of commerce, industry of association in upholding integrity and self-discipline, guide private enterprise towards legitimate business operations and integrity management, shoulder social responsibility, and fulfill the obligations to the employees. (The Provincial Department of Civil Affairs shall take the lead). We shall strengthen and improve the supervisory management to market entities and market activities, carry out special projects to rectify and standardize market order, establish a mechanism for collecting information on the origin of counterfeit products, and crack down on counterfeit and shoddy goods, unfair competition and other activities that disrupt market order. (The Provincial Market Supervision Bureau shall take the lead).

 29.We will protect the property right of private enterprises and personal and property security of entrepreneurs according to law. We shall strictly implement the opinions on the improvement of the property right  protection system to protect the property right according to law, establish and improve  the system of joint meetings for the protection of property rights, and construct a long-term mechanism for equal protection of the property rights of various market entities. ( The Political and Legal Affairs Committee of the Provincial Party Committee shall take the lead). We shall strengthen the efforts to protect property rights especially the intellectual property rights, revise “Patent Ordinance of Shandong Province” and “Interim Measures on Investigation and Punishment of Patent Counterfeiting in Shandong Province”, and establish a system of punitive damages for infringement of trademark rights, patent rights. (The Provincial Market Supervision Bureau and the Provincial Party Committee Propaganda Department shall take the lead). We will strictly standardize legal procedures for handling cases involving private enterprises and entrepreneurs, and compulsory measures such as detention, arrest, sealing up, distrain and freezing should be used with caution according to law to minimize the damage and impact on the legitimate rights and interests of the subject of property rights and normal business activities. We shall strictly differentiate the boundaries of economic disputes and economic crimes, and prevent criminal law enforcement from intervening in economic disputes. We shall strictly adhere to the principle of “No crime without law making it so; no penalty without law making it so, and no crime shall be convicted without proof of being guilty or not guilty”, so as to lift the mental load and go forward without any burden. (The Political and Legal Affairs Committee of the Provincial Party Committee shall take the lead). For enterprises that suffer loss of legal interest due to change of policies and planning adjustment, they shall be compensated and relieved in accordance with law and regulations. (Governments at all levels shall be responsible). We shall pay attention to the application of market-based and law-based means to cut production capacity and reduce energy consumption, standardize the law enforcement and supervision of environmental protection and work safety, resolutely avoid “one size fits all”. We shall formulate predictable standards for environmental protection, quality and safety to set aside necessary time and space for the transformation and upgrading of enterprises. (The Provincial Department of Ecological Environment, the Provincial Department of Emergency and the Provincial Market Supervision Bureau shall take the lead respectively).

30.We will strengthen legal guarantee system. We shall intensify efforts to clean up policy documents that violate the rules governing fair, open and transparent markets. By the end of the year, we shall have completed the inventory of local regulations, rules and policy documents that impede the unified market and fair competition, publicized to the whole society and accepted social supervision. (The Provincial Market Supervision Bureau and the Provincial Department of Justice shall take the lead). We shall actively establish a diversified dispute resolution mechanism, set up a plat form for enterprise property right dispute mediation, and provide more dispute resolution channels and rights protection options for enterprises. We shall crack down on various mafia-like gangs according to law, and protect the normal operation and management of enterprises. (The Political and Legal Affairs Committee of the Provincial Party Committee shall take the lead).

  31.We will strengthen the awareness of private enterprises to operate in accordance with the law. We shall intensify legal publicity and services for private enterprises, improve public legal service system, guide the broad masses of people in private sector to strengthen self-learning, self-education and self-promotion, practice core socialist values, actively undertake social responsibilities, proactively abide by the laws, regulations and rules on ecological environmental protection, production safety, quality standards, employee rights and interest etc., advocate entrepreneurial spirit, and strive to be a model of patriotism, law-abiding operation, entrepreneurship and innovation, and social returns. (The Provincial Department of Justice shall take the lead)

  32.We will properly resolve the problem of non-payment of debts owed to private enterprises. We shall properly handle the cases involving government debt arising from history in accordance with law, establish a consultation system for party and government organs to carry out case settlement, and promote the implementation of the judged government debt cases. (The Political and Legal Affairs Committee of the Provincial Party Committee shall take the lead). We shall reinforce the management of discredit      in government organs, and regularly clean up the problems of arrears of funds by government, analyze the reasons, pinpoint liabilities, and hold those government organs accountability for long-term delinquent funds. (The Provincial Development and Reform Commission and the Provincial Supervisory Commission shall take the lead). We shall strive to prevent large enterprises from using their dominant position to default on payments to small and medium-sized enterprises for a long period of time, and incorporate them into the black list for those that refuse to perform obligations of repayment. (The Provincial Development and Reform Commission and the Provincial State-owned Assets Supervision and Administration Commission shall take the lead).

 VI. Improve the way policies are implemented, give full play to the policy effect

 33.We will strengthen organization and coordination. We shall establish a provincial joint conference system for promoting the development of private economy, hold joint meetings on a regular basis, and make a good job of organization, leadership and work coordination for the development of private economy. (The Provincial Department of Industry and Information Technology shall take the lead). Party committees, governments at all levels, and the relevant departments directly under the provincial government shall pay high attention to the development of private economy, and the main responsible comrades should rush to the front to ensure the implementation of work. Each city should combine the local actual situation and formulate the implementation rules for the support of private economy and report by rule. Departments at all levels shall support and guide private enterprises, especially the middle and small enterprises to get over difficulties and to achieve innovative development, which shall be incorporated into the scope of cadre assessment. We shall continue to expand coverage of party organizations and work in private enterprises, make innovation of the modes of activities, promote the effective integration of the work of party construction and the enterprise production, operation and management, and boost high quality development of enterprises. (The Organization Department of Provincial Party Committee shall take the lead).

34.We will strengthen supervision and inspection. We shall further improve the statistical monitoring system for the private sector, and strengthen the analysis and judgment of the development trend of private economy. (The Provincial Bureau of Statistics shall take lead). We shall incorporate the index achieving status of the development of private sector and the optimization of business environment into the comprehensive assessment of the provincial economic and social development. (The Provincial Supervisory Commission shall take the lead). Supervision and inspection shall be made for the implementation of reform schemes for the benefit of private enterprises in the respect of property right protection, advocating spirit of entrepreneurs and Fair market competition review. (The General Office of the Provincial Government shall take the lead). We shall organize private enterprises to carry out service status evaluation of various departments, and the results shall be taken as the assessment basis of each department. (The Provincial Department of Industry and Information Technology, and the State Commission Office of Public Sectors Reform of the Provincial Party Committee shall take the lead). We shall strengthen the supervision of implementation of the development of private economy supported by departments at all levels, and we will hold accountable those who fail to implement the policies in place and fail to deal with the reasonable and legitimate demands of private enterprises. (The Provincial Supervisory Commission shall take the lead).

 35.We will pay close attention to the implementation of policies. All departments directly under the provincial government shall carefully review current preferential policies related to enterprises, make a list and make it public, carry out targeted inspections. We shall strengthen the principal responsibility for policy implementation.  Departments at all levels should combine with the implementation of “the Notice of People’s Government of Shandong Province on Issuing Several Policies for the Support of High-quality Development of Real Economy”(Luzhengfa 2018No.21), “Several Opinions of People’s Government of Shandong Province on Further Boosting Domestic Demand and Improving Weak Links” (Luzhengfa 2018No.24) and formulate concrete measures to promote the implementation of polices, detail the tasks, make clear the leading units, define work responsibilities, provide policy delivery service and ensure the implementation of various policies and publicity in place. Please each city, all departments directly under the provincial government report the implementation situation to the Provincial Party Committee and the Provincial Government by the end of this year and by the end of each semester in 2019 (Each city, all departments at all levels shall take the lead). In the second half of 2019, we shall carry out a third-party evaluation of policy implementation effect in the whole province so as to timely revise and improve relevant policies, dredge the blocked spots and pain spots, as well as promote the actual implementation of polices in details. (The General Office of the Provincial Party Committee, the General Office of the Provincial Government, and the Provincial Department of Industry and Information Technology shall take the lead)
